Legal status and regulation in Belgium
Bitcoin is fully legal in Belgium. Exchanges operate under the EU's MiCA regulation, and Belgium's law of 11 December 2025 assigned supervision of crypto-asset service providers to the FSMA, the financial markets authority, with the National Bank of Belgium handling prudential aspects for some firms. From 1 January 2026 a new federal capital gains tax applies to crypto: gains above an indexed annual exemption of 10,000 euros are taxed at 10 percent, while speculative or professional trading can still fall under older, higher regimes.
