Brazil has one of the world's largest crypto markets and one of its newest rulebooks, and the second is the thing to watch this year. The Banco Central do Brasil's virtual asset regime took effect on 2 February 2026, and every platform serving Brazilian clients, domestic or foreign, has until 29 October 2026 to apply for authorisation or stop and give customers 30 days to move their assets. Mercado Bitcoin is already inside that perimeter as a licensed payment institution, and Binance holds a broker-dealer and electronic money licence through its purchase of the brokerage Sim;paul. Legal status and regulation in Brazil
Bitcoin is fully legal in Brazil. Law No. 14,478 of 2022 created the legal framework for virtual assets, and the Banco Central do Brasil was designated as the market's regulator; its Resolutions 519, 520, and 521, issued in November 2025, established a full licensing regime for virtual asset service providers that took effect the following February, with existing firms required to apply for authorization or wind down. The securities regulator CVM keeps jurisdiction over crypto assets that qualify as securities.

How is bitcoin taxed in Brazil?
Gains are taxable, and the rules are the older ones after a failed attempt to change them. Provisional Measure 1303, which would have scrapped the monthly exemption for small sales and imposed a single flat rate, was pulled from the agenda by the Chamber of Deputies on 8 October 2025 by 251 votes to 193 and lapsed, so the previous treatment resumed: progressive rates from 15 percent, with the monthly exemption for small disposals intact. The government has postponed a fresh attempt until after the October 2026 election, so confirm current Receita Federal guidance before you file.
