Legal status and regulation in El Salvador
Bitcoin is fully legal in El Salvador and enjoys a uniquely supportive legal framework. The 2021 Bitcoin Law was amended in January 2025 as part of a 1.4 billion dollar IMF agreement: private-sector acceptance is now voluntary, taxes can no longer be paid in bitcoin, and the government agreed to wind down its Chivo wallet. The Comision Nacional de Activos Digitales licenses digital asset businesses, and gains on bitcoin remain exempt from capital gains tax.

Is bitcoin legal in El Salvador?
Yes, emphatically. Bitcoin has had a dedicated legal framework since the 2021 Bitcoin Law, and the Comision Nacional de Activos Digitales licenses digital asset businesses. The January 2025 amendment softened legal tender obligations but did not make bitcoin any less legal.
Do merchants in El Salvador still have to accept bitcoin?
No. The January 2025 amendment, passed to comply with El Salvador's IMF agreement, made private-sector acceptance voluntary. Many businesses still accept it, especially in tourist areas and Lightning-friendly towns, but they are no longer legally required to.
Do I pay tax on bitcoin gains in El Salvador?
No. Gains on bitcoin remain exempt from capital gains tax, one of the most generous treatments anywhere. Note that taxes themselves can no longer be paid in bitcoin following the 2025 reform.
What happened to the Chivo wallet?
Under the IMF agreement the government committed to gradually unwinding Chivo, its state-run wallet. Private apps like Strike and open-source Lightning wallets have long been the better-regarded options anyway, and they continue to operate normally.
