Legal status and regulation in the Netherlands

Bitcoin is fully legal in the Netherlands. Under the EU's MiCA regulation the Autoriteit Financiële Markten (AFM) licenses and supervises crypto-asset service providers, and it granted the EU's very first MiCA licences on 30 December 2024, with De Nederlandsche Bank keeping prudential roles. Firms without a MiCA licence have been prohibited from serving Dutch customers since 1 July 2025. For most private holders, crypto is taxed as part of Box 3 wealth rather than through a capital gains tax.

Is bitcoin legal in the Netherlands?

Yes. Bitcoin is legal to buy, hold, and sell, and platforms serving Dutch customers must hold a MiCA licence supervised by the AFM. Unlicensed providers have been barred since 1 July 2025.

Can I buy bitcoin with iDEAL?

Several platforms serving the Netherlands accept iDEAL deposits, which settle instantly from any Dutch bank account. Where iDEAL is unavailable, a SEPA Instant transfer is nearly as fast and just as cheap.

How is bitcoin taxed in the Netherlands?

For most private individuals, crypto counts toward Box 3 wealth: you are taxed annually on a deemed return over your total assets above the exemption threshold, not on each sale. Check the Belastingdienst's current Box 3 rules, which have been in flux.

What happened to exchanges without a MiCA licence?

The Dutch transition period ended on 30 June 2025, and from 1 July 2025 providing crypto services in the Netherlands without a MiCA licence became prohibited. Stick to platforms in the AFM's public register.
